(Flow Control)

AN ORDINANCE OF ESCAMBIA COUNTY, FLORIDA, AMENDING PART I, CHAPTER 82, ARTICLE IV OF THE ESCAMBIA COUNTY CODE OF ORDINANCES RELATING TO COLLECTION, STORAGE AND DISPOSAL OF SOLID WASTE; REQUIRING CERTAIN SOLID WASTE COLLECTED IN ESCAMBIA COUNTY TO BE DELIVERED TO THE PERDIDO LANDFILL, A PERMITTED TRANSFER STATION FOR ULTIMATE DELIVERY TO THE PERDIDO LANDFILL OR OTHER APPROPRIATE FACILITY, ENTITY OR PERSON RESPONSIBLE FOR DISPOSITION DESIGNATED BY THE COUNTY; PROVIDING FOR REMOVAL OF THE EXEMPTION GRANTED TO PENSACOLA NAVAL AIR STATION; PROVIDING FOR EXCEPTIONS; PROVIDING FOR ADMINISTRATIVE VARIANCES; PROVIDING FOR SEVERABILITY, PROVIDING FOR INCLUSION IN THE CODE AND PROVIDING FOR AN EFFECTIVE DATE. 

Clarification concerning Section 82-143.d:

Right of refusal.  Any solid waste determined by the Department of Solid Waste Management to be harmful, dangerous, or detrimental to the Department's personnel, equipment or operations may be rejected at the County’s solid waste management facilities.

The Department of Solid Waste Management (DSWM) cannot accept industrial or commercial hazardous waste, but will accept household hazardous waste from Escambia County citizens.  The DSWM has determined that requiring disposal of all Construction and Demolition Debris (C&DD) generated within Escambia County at the Perdido Landfill will not be enforced at this time.  Therefore, while the Perdido Landfill will accept Construction and Demolition Debris for disposal, the Department of Solid Waste Management is not requiring disposal of Construction and Demolition Debris at the Perdido Landfill.  Construction and Demolition Debris may be disposed of at any permitted Construction and Demolition Debris facility.

Please Note: All facilities for the disposal of Construction and Demolition Debris (C&DD) and Land Clearing Debris (LCD) in Escambia County, Florida must hold a valid permit from both the Florida Department of Environmental Protection (FDEP) AND the Escambia County Department of Solid Waste Management.
